The scope of personal data we collect:

We process your personal data for various purposes, but always in accordance with applicable law, in order to provide the highest possible level of service and pursuant to your expectations.
We obtain your personal data directly from you.
The scope of the personal data we process depends on the stage and the way in which the data are obtained, including, but not limited to, your expectations and requests (for example, your request to receive a VAT invoice).
We process the following personal data:
1. name and surname
2. address of residence
3. email address;
4. telephone number – to ensure the highest quality of the services we provide;
5. PESEL/NIP [personal identification number/taxpayer identification number] – if you wish to receive a VAT invoice or for future claims;
6. image – only if you are accessing our premises and for security purposes;
7. bank account number – only in the event of your claim for refund, upon your consent.


Purpose and legal basis for the processing of personal data:

The personal data referred to above shall be processed in the following cases:
– to conclude and perform a contract to which you are party or to take action on your request, prior to the conclusion of the contract, i.e., to make a price offer, to execute the contract, to perform the delivery, etc.
– on account of the legitimate interest of the administrator, such as, for example, the recovery of possible claims, or, in view of your satisfaction from provided services, to ensure your safety in the course of the services we provide, to adapt our services to your personal preferences;
– to comply with the legal obligation to which the controller is subject – for example, to issue VAT invoices and to meet obligations specified under tax law;
The legal basis for the processing of data is Article 6 section 1 letters b, c and f of Regulation (EU) 2016/679 of the European Parliament and the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation – hereinafter “the Regulation”), as well as the provisions of the Polish Civil Code and the tax provisions, including, in particular, the Polish Law on VAT.


Voluntary consent:

To the extent that the processing of your personal data takes place for the purpose of the performance of your contract, your data must be provided on condition that you enter into a contract. The provision of data is voluntary but necessary for the conclusion and implementation of the contract. If the data are not supplied to the extent necessary for the performance of the contract, the contract shall not be concluded in accordance with your request. It is a statutory obligation to provide the information necessary to issue the invoice and is based on the Law on Goods and Services Tax.

Right to object and right to withdraw consent:

If you grant consent on the processing of additional data, you will have the right to withdraw your consent at any time without affecting the lawfulness of the processing that you have made under your consent before its withdrawal. The data retention period:

The personal data collected for the purpose of the performance of the delivery and/or service contract shall be retained as long as necessary for the performance of the contract concluded with our Company and thereafter for a period corresponding to the limitation period of the claims.
Personal data processed in order to comply with the legal obligation to which the controller is subject shall be retained for the time necessary to comply with this obligation.
The data processed on the basis of your consent shall be processed until you withdraw this consent.
Personal data processed on the basis of a legitimate interest of the controller on the basis of the performance of a contract concluded with you, shall be processed until the legitimate interest on which the processing is based has been fulfilled.
After these periods, your personal data will be deleted or destroyed.


Categories of recipients:

Expected categories of data recipients: The Company PEBEK Sp. z o.o., i.e., its employees, as well as persons carrying out work in our Company on the basis of a contract of employment, a contract of mandate and cooperating, only to the extent necessary for the performance of the contract, as well as our contractors and companies with which we cooperate, only to the extent necessary for the performance of the contract. If necessary, we provide your personal data to our partners, such as lawyers, IT specialists or insurance companies. However, our conduct in this respect always complies with the applicable law.
Personal data will not be transferred to a third country.
The right of access and rectification, erasure, restriction, objection, transfer of personal data:
You have the right to request from the controller to access, rectification, erasure or restriction of personal data relating to you, as well as the right to object and the right to transfer your data. You also have the right to lodge a complaint with the supervisory authority (President of the Personal Data Protection Office). We would like to inform you that your data will be processed in an automated manner at the contracting stage to verify the accuracy of the data provided, but this will not lead to automated decision making. At the same time, we would like to inform you that the data will not be subject to profiling.
